We are a housing development company known for developing high-quality homes, with a focus on responsible development, improving local infrastructure and respecting the environment. We and our subsidiaries are committed to protecting the privacy and security of the Personal Data we process about you.

PURPOSE OF THIS PRIVACY NOTICE

The purpose of this privacy notice (“this notice”) is to explain what Personal Data we collect about you and how we process it. This notice also explains your rights, so please read it carefully. If you have any questions, you can contact us using the information provided below under the ‘How to contact us’ section.

WHAT IS PERSONAL DATA?

‘Special Category Personal Data’ is more sensitive Personal Data including information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for the purposes of uniquely identifying someone, data concerning physical or mental health or data concerning someone’s sex life or sexual orientation.

PERSONAL DATA WE COLLECT

The types of Personal Data we collect will depend on our relationship with you, but may include your:

Identity Data includes first name, maiden name, last name, marital status, title, date of birth and gender.
Contact Data includes address, email address and telephone numbers.
Financial Data includes credit data of potential tenants/tenants, banking details of clients, suppliers, agents and tenants for the making of payments by us and to us in relation to the services we provide and investment data in relation to properties.
Transaction Data includes details of products and services you have purchased from us.
Profile Data includes your purchases or orders made by you, your interests, preferences, feedback and survey responses.
Marketing and Communications Data includes your preferences in receiving marketing from us.

We may also collect, use and share Aggregated Data such as UK economic, property market, statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy notice.

Apart from industry-wide or governmental surveys where we are obliged to take part, we do not normally collect any Special Categories of Personal Data about you.

How we collect your data

We collect most Personal Data directly from you in person, by telephone, email and/or via our website. However, we may also collect your Personal Data from third parties such as:

through events and webinars;
reputable companies who provide lead generation contact lists;
others to whom you have provided consent; and
publicly available sources such as social media platforms.

PURPOSES FOR WHICH WE USE PERSONAL DATA AND THE LEGAL BASES

We will only use your Personal Data when the law allows. Most commonly, we will use your Personal Data in the following circumstances:

SHARING YOUR PERSONAL DATA

We may share your personal data with other companies in our group (subsidiaries) for analysis and research purposes. Our lawful basis for this processing is legitimate interests.

We may sometimes contract with the following categories of third parties to fulfil activities on our behalf. In some cases, those third parties may require access to some or all of your personal data that we hold. These third parties may include:

Service providers and suppliers, such as cloud storage services, acting as processors based in the EEA
Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors and insurers who are based in the EEA and who provide consultancy, banking, legal, insurance and accounting services.
HM Revenue & Customs, regulators and other authorities acting as processors or joint controllers based in the UK who require reporting of processing activities in certain circumstances.

If the third party needs access to any of your personal data to carry out any of the activities described above, we will ensure your personal data is handled safely, securely and in accordance with your rights, our obligations and the third party/our client’s obligations under the law. We will do this by entering into a Data Processing Agreement with them. This will ensure that the third-party company will only process your personal data in accordance with our strict instructions and will not use it for their own purposes.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority. Our lawful basis in these circumstances is legal obligation or legitimate interests, depending on the situation.

THIRD PARTY MARKETING

Currently, we do not share or pass on any personal data we receive from you to any third party for marketing purposes. All such personal data is retained within the Foreman Homes Group. We will get your express opt-in consent before we share your personal data with any company outside the Foreman Homes Group of companies for marketing purposes.

You can ask us to stop sending you marketing messages at any time by contacting us at any time.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

hOW LONG WE KEEP YOUR DATA

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Under English law we will normally have to keep basic information about our customers and services (including contact, identity and transaction data) for specified periods of time which can vary from between 6 years to 15 years. In the absence of a specific rule requiring us to keep personal data for a specific period, our current policy is to keep personal data for approximately 10 years. Personal data received in relation to an enquiry relating to a specific site is not shared with any third party or used for any purpose other than the relevant site, as it is kept for statistical purposes which helps us in running our business.

We may also anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

INTERNATIONAL TRANSFERS

Your Personal Data will not be processed outside the UK. However, should the position change, we will take appropriate steps to ensure that the Personal Data processed outside the UK has an essentially equivalent level of protection to that guaranteed in the UK. We will do this by ensuring that:

Your Personal Data is only processed in a country which the Secretary of State has confirmed has an adequate level of protection (an adequacy regulation), or

Automated decision-making. You have the right not to be subject to a decision based solely on automated processing which will significantly affect you. We do not use automated decision-making.

If you have provided your consent for us to process your Personal Data for a specific purpose, you have the right to withdraw your consent at any time. If you do withdraw your consent, we will no longer process your information for the purpose(s) you originally agreed to, unless we are permitted by law to do so.

HOW TO EXERCISE YOUR RIGHTS

You will not usually need to pay a fee to exercise any of the above rights. However, we may charge a reasonable fee if your request is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

If you wish to exercise your rights, you may contact us using the details set out below in the ‘Contact us’ section, below. We may need to request specific information from you to confirm your identity before we can process your request. Once in receipt of this, we will process your request without undue delay and in any event within one month. In some cases, such as complex requests, it may take us longer than this and, if so, we will keep you updated.

DATA PROTECTION OFFICER

We do not have a statutory requirement to appoint a Data Protection Officer (“DPO”) under the UK GDPR. However, for accountability and compliance purposes, we have voluntarily appointed Evalian Limited, a company specialising in data protection, cyber security and information security, as our DPO. We may update this notice from time to time as shown at the top of this notice. We will notify of the changes where required by applicable law to do so.
